By accessing or using the Kind Health Texas website, patient portal, or telehealth services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this website or our services.
2. Nature of Services
Kind Health Texas, PLLC and its affiliates provide outpatient psychiatric and mental health services via telehealth (video and/or audio communication). Our services include psychiatric evaluations, medication management, and related mental health care delivered remotely by licensed healthcare providers.
3. Medical Disclaimer
The information provided on this website is for general informational purposes only and is not intended as medical advice, diagnosis, or treatment. Nothing on this site should be considered a substitute for professional medical advice from a qualified healthcare provider.
The establishment of a provider-patient relationship occurs only after you have completed intake paperwork, consented to treatment, and been accepted as a patient by a Kind Health Texas provider. Simply visiting this website or submitting an inquiry does not create a provider-patient relationship.
4. Telehealth Informed Consent
By using our telehealth services, you acknowledge and agree to the following:
- Telehealth involves the use of electronic communications to deliver healthcare services when the provider and patient are not in the same physical location.
- Telehealth has potential benefits, including improved access to care and convenience, but also potential risks, including technology failures, limited ability to perform physical examinations, and the possibility that information transmitted may not be sufficient to allow for appropriate medical decision-making.
- You have the right to withdraw consent for telehealth services at any time.
- Your provider may determine that telehealth is not appropriate for your care and may require an in-person visit or referral to another provider.
- You are responsible for ensuring a private, appropriate environment during telehealth appointments.
5. Not a Crisis or Emergency Service
Kind Health Texas, PLLC and its affiliates do not provide emergency or crisis services. Our telehealth services are not appropriate for psychiatric emergencies.
If you are experiencing a medical or psychiatric emergency, call 911 immediately.
If you are having thoughts of suicide or self-harm, contact the National Suicide Prevention Lifeline at 988 or go to your nearest emergency room.
Do not use email, the patient portal, or website contact forms for urgent or emergency matters. These communications are not monitored in real-time.
6. Patient Responsibilities
By using our services, you agree to:
- Provide accurate and complete information about your medical history, current medications, and health conditions.
- Inform your provider of any changes in your health status or medications.
- Follow treatment recommendations or communicate openly if you choose not to.
- Attend scheduled appointments or provide adequate notice for cancellations.
- Ensure you are physically located in the State of Texas during telehealth appointments (required for licensure compliance).
- Use the telehealth platform in a private setting where confidentiality can be maintained.
- Refrain from recording telehealth sessions without prior written consent.
7. Prescribing Policies
Prescription medications, including controlled substances, may be prescribed at the sole discretion of your provider based on clinical appropriateness. By using our services, you acknowledge:
- Controlled substances will only be prescribed when clinically indicated and in accordance with state and federal regulations.
- Kind Health Texas, PLLC and its affiliates reserve the right to decline or discontinue prescribing any medication at any time.
- You agree not to seek the same or similar controlled substances from multiple providers simultaneously.
- Refill requests require adequate notice and may require a scheduled appointment.
- Lost, stolen, or destroyed medications may not be replaced, particularly controlled substances.
8. No Guarantee of Outcomes
Mental health treatment outcomes vary by individual. Kind Health Texas, PLLC and its affiliates make no guarantees regarding the results of treatment. Progress depends on many factors, including individual participation, adherence to treatment plans, and circumstances beyond our control.
9. Technology Requirements
Telehealth services require adequate technology, including a device with video and audio capability and a stable internet connection. You are responsible for ensuring your technology meets these requirements. Kind Health Texas, PLLC and its affiliates are not responsible for disruptions in service due to technology failures on your end.
10. Payment and Insurance
By using our services, you agree to the following:
- Payment is due at the time of service unless other arrangements have been made.
- If we accept your insurance, you are responsible for any copays, coinsurance, deductibles, or non-covered services.
- If we do not accept your insurance, you are responsible for payment in full and may seek reimbursement from your insurer directly.
- Fees for services, including late cancellation or no-show fees, will be communicated to you in advance.
- Failure to pay for services may result in discharge from the practice and/or referral to collections.
11. Cancellation Policy
We require at least 24 hours’ notice for appointment cancellations or rescheduling. Late cancellations or missed appointments may be subject to a fee. Repeated no-shows may result in discharge from the practice.
12. Privacy and Confidentiality
Your use of our services is governed by our Privacy Policy, which describe how we collect, use, and protect your personal and health information in accordance with HIPAA and applicable state laws. By using our services, you consent to the practices described in those documents.

In such cases, we will provide reasonable notice and referrals to alternative providers when appropriate.
19. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these terms or your use of this website or services shall be subject to the exclusive jurisdiction of the courts located in Dallas County, Texas.
20. Changes to Terms
